These Terms of Service (the “Terms”) govern your access to and use of the website at badfishslayers.com and any related subdomains or pages we operate (collectively, the “Site”), which are operated by Badfish Slayers LLC (“Badfish Slayers,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to submit forms, transact, or otherwise interact with the Site beyond browsing. By using the Site you represent that you meet these requirements and that all information you provide is true and accurate.

2. Informational Use Only — No Professional Advice

Content on the Site — including pages discussing invasive lionfish, reef ecology, removal techniques, diving, dive shops, equipment, and conservation — is provided for general informational and educational purposes only. It is not, and should not be relied on as, professional, scientific, medical, safety, legal, regulatory, veterinary, or environmental advice.

Diving and lionfish removal are inherently dangerous activities that can cause serious injury or death, including from drowning, decompression illness, marine life encounters, equipment failure, and venomous lionfish spines. You should only dive or attempt lionfish removal if you are properly trained, certified, equipped, insured, and acting in accordance with all applicable laws and permit requirements. Always consult a qualified dive professional, follow manufacturer instructions for any equipment, and obtain appropriate medical care for any injury. You participate in any diving or removal activity at your own risk.

3. Mission, Donations, and Purchases

Badfish Slayers operates with a conservation mission focused on reef protection and invasive lionfish removal. References on the Site to “support,” “supporting the mission,” or “proceeds” describe how we allocate revenue to mission activities and are not representations that any payment to us is a tax-deductible charitable contribution. Unless we expressly state otherwise in writing, payments to Badfish Slayers LLC are consideration for goods, services, or general support and should not be treated as deductible donations for tax purposes. Consult your tax advisor regarding the treatment of any payment.

Merchandise and other products are sold through a separate e-commerce platform. The shop platform’s own terms of sale, return policy, shipping terms, and privacy policy govern those transactions. We are not responsible for the operation of, or transactions completed on, third-party platforms.

4. Dealer Inquiries and Submissions

The dealer inquiry form and any other contact channels are intended for legitimate business inquiries from dive shops, charters, partners, and supporters. By submitting information, you confirm it is accurate, that you have authority to provide it on behalf of any business you mention, and that we may contact you in response. Submitting an inquiry does not create a dealer, agency, partnership, or employment relationship; any such relationship requires a separate written agreement signed by Badfish Slayers.

5. Intellectual Property

The Site, including its text, graphics, logos, photographs, videos, design, trademarks, and other content (collectively, the “Content”), is owned by or licensed to Badfish Slayers and is protected by U.S. and international intellectual property laws. You may view and share the Site for personal, noncommercial use. You may not copy, reproduce, modify, distribute, publicly display, create derivative works from, scrape, or use the Content for any commercial purpose without our prior written permission. “Badfish Slayers” and any associated logos are trademarks of Badfish Slayers LLC.

We do not control and are not responsible for third-party content, products, services, terms, or privacy practices. Listings of dive shops or partners on the Site are not endorsements and do not guarantee the quality, safety, or availability of any third party’s products or services. You deal with third parties at your own risk.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT ANY CONTENT IS ACCURATE OR COMPLETE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BADFISH SLAYERS LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, VOLUNTEERS, AGENTS, AND AFFILIATES (THE “BADFISH PARTIES”) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

10. Assumption of Risk — Diving and Marine Activities

You expressly acknowledge that diving, snorkeling, spearfishing, lionfish removal, handling marine wildlife (including venomous species), and related boating and water activities involve substantial risk of injury, illness, property damage, and death. You assume all such risks. The Badfish Parties are not your dive instructors, dive masters, charter operators, medical providers, or guides, and nothing on the Site creates such a relationship. Nothing on the Site is a substitute for in-person training, certification, supervision, and judgment by qualified professionals.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Badfish Parties from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site; (b) your violation of these Terms or any law or third-party right; or (c) any information you submit through the Site.

12. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida, without regard to its conflict of laws rules. The exclusive venue for any dispute that is not subject to arbitration (where applicable) or that a court determines is not arbitrable, shall be the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

13. Informal Dispute Resolution

Before filing any claim, you agree to first attempt to resolve the dispute informally by contacting info@badfishslayers.com with a written description of the dispute and the relief sought. The parties will make a good-faith effort to resolve the dispute for at least 30 days before escalating.

14. Changes to the Site or Terms

We may modify, suspend, or discontinue all or part of the Site at any time without notice. We may also update these Terms from time to time. Material changes will be posted on this page with a new “Last updated” date. Your continued use of the Site after the changes are posted constitutes your acceptance of the updated Terms.

15. Miscellaneous

These Terms, together with the Privacy Policy and any other agreement expressly referenced, constitute the entire agreement between you and Badfish Slayers regarding the Site. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms; we may assign them to an affiliate or successor.
